Terms of Use (End User License Agreement)

1. Acceptance of Terms

By downloading, installing, or using Habit Goal Tracker ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.

3. Subscription Terms

3.1 Subscription Plans

The App offers the following auto-renewable subscription options:

• Monthly Pro: Subscription renews monthly at the listed price
• Yearly Pro: Subscription renews annually at the listed price
• Lifetime Pro: One-time purchase with permanent access (non-subscription)

3.2 Payment

• Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The cost of renewal will be the same as the original subscription price unless otherwise notified

3.3 Managing Your Subscription

• You can manage and cancel subscriptions through your App Store or Google Play Store account settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for unused portions of a subscription period

3.4 Free Trial (if applicable)

• If a free trial is offered, you will be charged the subscription price at the end of the trial period unless you cancel before the trial ends
• Free trials are available only once per user

4. User Account

• You may need to create an account to use certain features of the App
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the App or its related systems
• Interfere with or disrupt the App's functionality
• Upload or transmit viruses, malware, or other harmful code
• Harass, abuse, or harm other users
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright, trademark, or proprietary notices

6. Intellectual Property

• The App and all content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws
• You retain ownership of the content you create in the App (habits, goals, notes, etc.)
• By using the App, you grant us a license to store and process your content to provide the App's services

7. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Disclaimers

• The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied
• We do not guarantee that the App will be uninterrupted, secure, or error-free
• We do not guarantee the accuracy, completeness, or usefulness of any information in the App
• The App is not a substitute for professional medical, psychological, or health advice

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted through the App

10. Termination

• We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms
• Upon termination, your right to use the App will immediately cease
• You may delete your account at any time through the App settings

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

14. Apple App Store Additional Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and us, not with Apple, and Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support services for the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you

15. Google Play Additional Terms

If you download the App from Google Play, you agree to comply with Google Play's Terms of Service.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.

By using Habit Goal Tracker, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
